Our platform empowers teachers to create and share educational content and learners to access it globally. These Terms govern your use of Takbir’s platform, mobile applications, APIs, and other services (collectively, "Services"). By using Takbir, you agree to these Terms. 1. Definitions

To help clarify key terms used throughout these Terms of Service, here are simple definitions:

  1. Takbir: Refers to our company, including the platform, services, and associated applications.

  2. Services: All functionalities, applications, and features offered by Takbir, including mobile apps, APIs, and website content.

  3. User: Any individual who accesses Takbir’s Services, including learners, instructors, and visitors.

  4. Learner: A user who enrolls in or accesses educational content on Takbir."

  5. Teacher: A user who creates and uploads educational content to share with learners on Takbir.

  6. Content: Refers to courses, videos, text, images, quizzes, assignments, or any material uploaded by instructors or hosted on the platform.

  7. Account: A registered user profile that allows access to Takbir’s Services.

2. Accounts

2.1 Creating and Maintaining Your Account

To access most of Takbir’s services, it is essential to create a user account. During the account creation process, you are required to provide accurate and complete information, including a valid email address. This ensures that your account remains functional and you receive important notifications. We recommend choosing a strong password and safeguarding it to maintain the security of your account. You are fully responsible for all activities that occur under your account, including the actions of anyone who uses it, whether authorized by you or not. If you notice any unauthorized use or suspect that your account has been compromised, you must inform us immediately to take the necessary actions to protect your data.

Eligibility: To use Takbir’s services, you must meet the minimum legal age requirement of your country of residence. If you are under the age of 18, a parent or legal guardian must create the account on your behalf and take responsibility for all activities carried out through the account. We reserve the right to request proof of age if needed to ensure compliance with applicable laws and regulations.

2.2 Account Termination

Takbir reserves the right to suspend or terminate any account that violates these Terms of Use. Violations may include but are not limited to providing false or misleading information during account registration, unauthorized access to the platform, or engaging in spam, abusive behavior, or other prohibited activities. In such cases, account suspension or deactivation may occur without prior notice. If your account is suspended or terminated, you have the right to dispute the decision within 14 days of receiving the notification. To do so, you must contact our support team and provide relevant details regarding the issue. 3. Content Enrollment and Lifetime Access

3.1 Learner Rights

When you enroll in a course on Takbir, you are granted a personal, non-transferable license to access the course content. This license is strictly for educational purposes and is intended for your individual use only. Generally, we offer lifetime access to most courses unless explicitly stated otherwise. However, your right to access a course may be revoked if you violate legal requirements or breach Takbir’s policies. While enrolled, you may view and utilize course materials for personal learning, but sharing, reselling, or redistributing the content to third parties is strictly prohibited. Additionally, downloading materials for any purpose other than personal, offline use is not allowed and may result in account

3.2 Teacher Rights

Teachers on Takbir maintain full intellectual property rights over the content they create and upload to the platform. By submitting their educational materials, Teachers grant Takbir a non-exclusive license to host, distribute, and promote their content on the platform. This allows Takbir to make the courses accessible to learners while ensuring the content creators’ rights are preserved. Takbir reserves the right to remove any course content that is found to violate platform policies, community standards, or legal obligations. This may include content deemed inappropriate, misleading, or otherwise harmful to users. Teachers will be notified if their content is removed, and they may appeal the decision if they believe the removal was unwarranted. To maintain the platform’s focus on Islamic knowledge, Teachers are only permitted to teach subjects related to Deen, including Quranic studies, Hadith, Fiqh, Islamic history, and similar topics. Courses that do not align with the platform’s educational objectives, such as non-Islamic academic subjects, are not allowed. This ensures that Takbir remains a specialized space for Islamic learning and spiritual growth.

4. Payments and Refunds

4.1 Payments

To access premium content or services on Takbir, you are required to make payments using valid and accepted payment methods. These methods may include credit cards, debit cards, online payment systems, or other forms of electronic payment as specified at the time of purchase. All payments are securely processed through trusted third-party services to protect your financial information and ensure smooth transactions. To ensure the security of your payment information, Takbir collaborates with payment services such as Stripe, which offers the most convenient payment options in your region. By completing a purchase, you agree to pay the applicable fees and taxes as outlined at the point of sale. Takbir reserves the right to change the pricing structure for its services at any time; however, any changes will not affect the pricing of content you have already purchased. You will not be charged retroactively for any previously acquired content.

4.2 Refunds

At Takbir, we value your satisfaction and aim to deliver quality educational content. If you are not satisfied with a purchased course or service, you may request a refund within 30 days of purchase. Refunds are generally processed if the request is made within the specified timeframe and if the course content has not been excessively consumed or completed. Teachers may have the option to set their own refund policies, as long as they meet or exceed Takbir’s standard policy.

It is important to note that refund requests are subject to review, and Takbir reserves the right to deny a refund if the request is deemed inappropriate or excessive. Users found to be abusing the refund policy, such as requesting multiple refunds without valid reasons, may face account restrictions. If you wish to dispute a refund decision or raise a concern, you must do so within 14 calendar days of the incident. After this period, disputes may no longer be considered.

5. Content and Conduct Policy

5.1 Acceptable Use

Users are required to use the Takbir platform in a responsible, ethical, and lawful manner. Any form of illegal activity, harassment, discrimination, or content that violates intellectual property rights is strictly prohibited. Users are also advised against sharing personal information publicly or privately through the platform. Takbir strives to maintain a safe and respectful environment, and any violation of these guidelines may lead to account suspension or termination.

5.2 Intellectual Property

Teachers are responsible for ensuring that the content they upload is original and does not infringe upon the copyrights or intellectual property rights of others. If any copyright infringement or violation is reported, Takbir will investigate the matter and take appropriate action, which may include removing the content or restricting access. Users are encouraged to report any instances of copyright violations or intellectual property abuse they encounter on the platform.

5.3 Content Monitoring

While Takbir takes proactive measures to monitor content quality and compliance, it is not feasible to pre-screen every piece of content uploaded to the platform. Therefore, users are encouraged to report any inappropriate or harmful content they come across. Takbir will review such reports and take necessary actions to maintain community standards. 5.4 Identity Verification

To ensure the safety and integrity of our community, Takbir may request identity verification from users, particularly teachers, at any time. Verification may involve submitting government-issued identification or other relevant documents. Failure to comply with verification requests within the given timeline may result in account suspension or deactivation (Reference: Freelancer).

5.5 Ownership and License

Instructors maintain full ownership of the content they create and upload to Takbir. By hosting content on the platform, teachers grant Takbir a non-exclusive, worldwide license to distribute, promote, and monetize the material. This license is necessary to make the content accessible to learners and to facilitate the platform’s educational mission.

5.6 Content Removal

Takbir reserves the right to remove any content that violates its policies, community guidelines, or legal regulations. Teachers will be notified if their content is flagged for removal, and they may appeal the decision within a specified period. Content may be removed without prior notice if deemed harmful or non-compliant (Reference: Udemy).

5.7 Subject Limitations

To preserve the platform’s focus on Islamic education and values, teachers are permitted to offer courses related to Deen, including Quranic studies, Hadith, Fiqh, Islamic history, and similar topics. Additionally, courses that positively impact personal growth, community service, or ethical leadership within the Islamic context are encouraged. Non-Islamic or unrelated subjects are not permitted and may be removed if found in violation (Reference: Udemy).

5.8 Data Usage and Consent

By using our services, you grant Takbir the right to use the data you provide across Takbir and its associated platforms for internal purposes, including promotion and service optimization. We are committed to your privacy and expressly state that your data will not be sold or transferred to data brokers or third parties in exchange for monetary compensation. Your data remains within the Takbir ecosystem and will be handled with integrity and transparency.

6. Using the Platform at Your Own Risk

6.1 Educational Content

Takbir does not guarantee the accuracy, completeness, or reliability of the content provided. Users are encouraged to critically evaluate the information and cross-reference it with credible sources when needed. Any educational or personal decisions made based on the content on Takbir are done at your own discretion and risk. The platform is not liable for any outcomes resulting from the use of educational materials, including but not limited to academic results, professional qualifications, or personal growth.

6.2 Interactions

The Takbir platform serves as a community-driven educational environment where users may interact with each other through discussions, comments, and collaborative learning opportunities. While we encourage positive and respectful interactions, we do not actively monitor or control every exchange between users. All rights to the Takbir name, logo, and other branding elements are reserved solely by Takbir. Any unauthorized use, reproduction, or distribution of these elements is strictly prohibited and may result in legal action. By accessing and using the Takbir platform, you acknowledge that you do not acquire any ownership rights to any part of the platform or its content.

7.2 Feedback and Suggestions

Takbir welcomes user feedback and suggestions for improving the platform. While we value and appreciate your input, please be aware that any feedback or suggestions you provide are entirely voluntary. By submitting feedback to Takbir, you grant us a non-exclusive, royalty-free, perpetual, and irrevocable license to use, modify, and incorporate your suggestions into the platform without any obligation or compensation to you.
